Supplemental Booking Terms

Terms of Service

1.0 Purpose and Acceptance

1.1 Applies to all bookings.

These Terms of Service (the “Terms”) provide practical operating requirements for photo booth, video guest book, drop-off, and related event bookings with A Notch Above Events, LLC (the “Company”). Only the features included in the purchased package or approved add-ons are provided. Rules about attendants, prints, video recording, outdoor installations, delivery, and pickup apply only when relevant to the purchased service.

1.2 Relationship to signed agreement.

These Terms supplement the signed Photo Booth & Event Services Agreement (the “Agreement”) and the checkout/order confirmation. If a provision conflicts, the signed Agreement controls, except that an expressly agreed written amendment may control and the order confirmation determines the services and charges actually purchased. Payment, retainers, cancellations, rescheduling, liability, insurance, and dispute resolution are governed by the Agreement, not by competing policies in these Terms.

2.0 Reservations and Payment

2.1 Booking and balance.

A booking is confirmed only after the signed Agreement and applicable retainer are received. The retainer is $300 for Traditional Photo Booth and Video Booth/Video Guest Book packages and $150 for other booth packages, unless the accepted order states a different offer. Applicable sales tax is added at checkout. Unless otherwise agreed in writing, the remaining balance is due 14 calendar days before the event; bookings made within 14 days require payment in full at confirmation. Company is not required to attend or perform at an event that remains unpaid on the event date.

2.2 Extra time.

Extra booth hours purchased before the event are $100 per hour. Hours requested during the event are $150 per hour, payable before the extension begins and subject to availability and venue permission. Changes, cancellations, date changes, refunds, and travel are governed by the signed Agreement; no separate penalty, refund rule, or arbitration requirement is added here.

3.0 Space, Setup Access, and Power

3.1 Recommended space.

For a comfortable installation, Company suggests approximately 8 × 8 × 8 feet for an open-air setup and 8 × 10 × 8 feet for most enclosed setups. These are recommendations, not inflexible minimums. An open-air booth can often be adapted to a smaller space if Company determines it is safe and workable. The Cube booth, however, requires at least 8.5 feet of unobstructed width, depth, and height simply to fit, plus any additional safe access clearance Company specifies. The Cube cannot be installed outdoors.

3.2 Electricity and access.

Client must provide safe, level placement and a grounded 110–120V, 15-amp outlet within approximately six feet of the booth location unless an alternative is agreed in advance. Company carries extension cords, but Client must disclose outlet and venue restrictions ahead of time. Client must coordinate venue admission, outside-vendor authorization, loading, parking, and an appropriate space. If the venue refuses Company entry after Company arrives on-site ready to perform because Client has not obtained authorization or facilities, the payment provisions in the Agreement apply.

3.3 Setup times.

For attended bookings Company generally plans arrival about 60 minutes before service begins. Typical setup takes about 45 minutes, but can take about 30–90 minutes depending on the booth and circumstances. Client must make advance access available as reasonably requested and disclose restrictions before the event. Setup and breakdown are not included in contracted guest operating hours unless agreed otherwise.

4.0 Outdoor Events, Shelter, Weather, and Relocation

4.1 Client-provided protection.

The Cube is indoor-only. For a permissible outdoor booth, Client must provide a suitable covered shelter, stable and level ground, safe electricity, and a location protected from rain, wind, water, and other risks. A tent is not automatically included. If arranged sufficiently in advance and available, Company can supply a tent or alternative power at an additional agreed cost. An indoor backup location is strongly recommended but not mandatory.

4.2 Weather and safe operation.

Company may suspend, decline, or stop unsafe outdoor operations. If Company has already arrived on-site with staff and equipment ready for an outdoor event and unsafe weather, inadequate protection, or a voluntary venue cancellation prevents performance, the full agreed booking fee remains due without refund to the extent permitted by law, subject to the separate extraordinary-force-majeure and government-closure provisions of the Agreement. Moving a booth after setup starts or finishes may involve additional agreed charges and may reduce operating time.

5.0 Lighting and Internet

5.1 Lighting and image quality.

Open-air backdrops should not be positioned directly in front of windows. For outdoor events, consider the direction of the sun, afternoon glare, and sunset when choosing a booth location. Company will make reasonable efforts to optimize lighting during setup but cannot guarantee results affected by direct sunlight, window backlighting, DJ lights, venue spotlights, or lighting outside Company’s control.

5.2 Required Wi-Fi.

Client must provide access to a stable working venue Wi-Fi network and any needed access credentials during setup. If Wi-Fi is unavailable, Company may attempt to use a 5G hotspot, but cellular coverage and connectivity are not guaranteed. Photo texting, email delivery, online galleries, and cloud-connected features may be unavailable or delayed; where practicable, available captured photos may be delivered after the event. An external connection problem is not itself a failure of the photo-capture equipment.

6.0 Technical Issues and Printing

6.1 Minor interruptions.

Brief pauses for restarts, paper or ink replacement, and troubleshooting can occur. Company will try to restore operation and make up Company-caused lost booth time when practical. Refund eligibility for booth-operation downtime begins only when unrecovered Company-caused lost time exceeds 20% of contracted operating time, as set out in Section 7.2 of the Agreement.

6.2 Printer-only interruption.

When a package includes prints and a printer failure cannot be promptly corrected but the booth can continue capturing photos and furnishing usable digital or text copies, Company may substitute digital delivery or make files available afterward where needed. Any refund solely for loss of on-site printing is capped at $100 for the booking, subject to applicable law. A complete inability to capture photos is evaluated under the equipment-downtime clause of the Agreement, not the printer-only rule.

7.0 Guests, Image Sharing, and Promotional Use

7.1 Guest conduct.

Client must help maintain a safe guest environment. Attendants may refuse service to an individual guest acting unsafely, damaging or mishandling equipment, fighting, harassing others, or otherwise disrupting service, subject to applicable law. Attendants may suspend or end service when safety requires, under the process in the Agreement. Children may be required to have an adult supervise booth use.

7.2 Shared gallery — enabled by default.

When a guest texts themselves a photo, that guest may also be able to view other photos taken at the event through a shared album and may share a gallery link. Client is responsible for notifying guests before they use the booth that this shared-gallery access is enabled. The host may ask Company before the event to disable event-wide gallery access for guests. Company does not routinely post separate signs at the booth. This notice arrangement does not replace any individual’s rights or any nonwaivable legal duties.

7.3 Promotional materials and opt-out.

The Agreement permits limited promotional use of event images and non-private video excerpts where legally authorized, subject to Client’s and individuals’ right to request removal from Company-controlled promotions. Clients can opt out of event promotional use by written notice. A booking host cannot automatically authorize advertising use of every guest’s likeness, and legally necessary permission must be obtained separately, including parent or guardian authorization where required for recognizable minors.

8.0 Drop-Off Equipment, Photos, and Delivery

8.1 Unattended rentals.

For a drop-off or unattended package, Client must protect Company equipment against theft, weather, misuse, and unauthorized movement during the rental period, provide suitable power and Wi-Fi, follow reasonable setup/use instructions, report problems promptly, and make the equipment available for agreed pickup. Liability for damage is limited as set out in the Agreement and is not automatic for disasters outside Client’s control.

8.2 Files, video guest books, and albums.

When included in the package, digital photos and video messages are furnished in the agreed manner. Company offers online albums for at least one year after the event, with longer availability as storage allows; download and back up desired files. Video guest book content designated private is not intentionally published by Company. Printed albums, when purchased, are generally delivered within four to six weeks after needed selections or approvals. Individual package terms may state more specific deliverables.

9.0 Legal Terms and Notices

9.1 Applicable protections.

These Terms do not require mandatory arbitration or create a blanket waiver of claims. The Agreement’s notice, mediation, limitation-of-liability, insurance, indemnity, Ohio-law, severability, and electronic-acceptance provisions apply. Nothing here eliminates remedies that cannot legally be waived.

9.2 Requests and Changes

Requests to change the date, disable shared galleries, opt out of marketing, obtain insurance certificates, or arrange special power/shelter must be communicated through the Company’s approved booking or written contact channels. Only written, confirmed modifications change the purchased service or fee.

These Terms of Service supplement the signed Photo Booth & Event Services Agreement. Both documents are binding upon acceptance. In the event of any conflict or inconsistency, the signed Photo Booth & Event Services Agreement shall take precedence.
